These Terms and Conditions govern all rubbish removal, waste clearance and related services provided by Rubbish Removal Westminster. By making a booking, using our website, or allowing our team to enter your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions the following words shall have the meanings set out below:
1.1 "Company", "we", "us" or "our" means Rubbish Removal Westminster, the provider of waste collection and clearance services.
1.2 "Customer", "you" or "your" means the individual or business ordering services from us.
1.3 "Services" means any rubbish removal, waste collection, clearance, loading, transportation, or related service provided by us.
1.4 "Waste" means any rubbish, junk, furniture, appliances, garden waste, construction debris or other materials that you ask us to remove, subject always to applicable waste regulations.
1.5 "Booking" means a confirmed request for Services, whether made by telephone, email or online.
2.1 We provide rubbish removal and waste collection services for domestic and commercial customers within our operational area. Our services typically include the loading, transportation and disposal or recycling of Waste in accordance with UK waste regulations.
2.2 We reserve the right to refuse the removal of any items that are hazardous, illegal or outside our licence and insurance cover, including but not limited to asbestos, certain chemicals, gas bottles, clinical or medical waste, and other restricted materials.
2.3 Any indicative description of the Services on our website or promotional materials is for general guidance only. The exact scope of the Services will be as agreed and confirmed at the time of your Booking and, where relevant, at the time of collection following on-site assessment.
3.1 You may request a quote and place a Booking for our rubbish removal Services by telephone, email or through our online enquiry form where available.
3.2 When making a Booking, you must provide accurate and complete information about the Waste to be collected, including the type, approximate quantity, access conditions, property layout and any potential hazards.
3.3 Any quote provided based on your description of the job is an estimate only. The final price will be confirmed by our team once they arrive on site and have inspected the Waste, access route and any other relevant circumstances.
3.4 A Booking is not confirmed until we have accepted it and notified you of a collection date and time window. We reserve the right to decline any Booking request without providing a reason.
3.5 Time and date of collection are offered subject to availability. While we aim to attend within the agreed time window, all times are estimates and not guaranteed. We will not be liable for any loss or damage arising from delay, provided we act with reasonable care and diligence.
4.1 You must ensure that either you, or a responsible adult authorised by you, is present at the property at the agreed collection time to grant access, confirm the items to be removed, and make payment where required.
4.2 You are responsible for ensuring safe and adequate access to the Waste. This includes, where applicable, arranging parking, providing any necessary permits, ensuring communal or gated entrances can be opened, and making sure that access routes are clear and safe for our team.
4.3 You must ensure that the Waste presented for removal matches the description provided at the time of Booking. We reserve the right to revise the price or refuse to collect some or all of the Waste if the actual job differs significantly from the Booking details.
4.4 You must not include in the Waste any items that are classified as hazardous or prohibited under waste regulations or under these Terms. If such items are discovered, we may refuse to remove them, charge an additional fee, or cancel the job.
5.1 Prices for our rubbish removal Services are generally based on factors such as the volume and weight of Waste, the nature of materials, labour time, access conditions and disposal or recycling costs.
5.2 Any quote given before our arrival is an estimate only. The final price will be confirmed by our team on site once they have inspected the job. No work will be carried out until you have agreed to the final price.
5.3 Where you request additional work on site that is outside the scope of the original Booking or quote, we will confirm any adjusted price with you before proceeding.
5.4 All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes as required by law. Unless explicitly stated otherwise, prices are exclusive of VAT.
6.1 Payment is due in full at the time the Services are completed, unless we have agreed alternative payment terms with you in writing prior to the collection.
6.2 We accept typical payment methods used for local services, such as major debit and credit cards, bank transfer or cash, subject to availability and our policies in effect at the time of your Booking.
6.3 Where payment is not made on completion of the Services, we reserve the right to charge interest on any overdue amount at the statutory rate from the date payment becomes due until payment is received in full.
6.4 Title to any Waste collected transfers to us only once payment has been made in full. Until that time, we reserve the right to retain the Waste or return it to you if payment is not received.
7.1 You may cancel or amend your Booking by contacting us by telephone or email. Any cancellation or amendment is not effective until we have acknowledged it.
7.2 If you cancel your Booking more than 24 hours before the agreed collection time, no cancellation fee will normally be charged.
7.3 If you cancel within 24 hours of the agreed collection time, or if our team arrives at the property and is unable to carry out the job due to your act or omission (including no access, no parking, or absence of an authorised person), we reserve the right to charge a call-out fee or a reasonable proportion of the quoted price to cover our costs.
7.4 We may cancel or reschedule your Booking at any time due to circumstances beyond our reasonable control, including but not limited to extreme weather, vehicle breakdown, staff illness, road closures or safety concerns. In such cases, we will contact you as soon as reasonably possible to arrange an alternative time. We will not be liable for any loss arising from such cancellation or rescheduling.
8.1 You are responsible for providing suitable and lawful parking for our vehicles at or near the collection address. Where parking restrictions apply, you must arrange and pay for any necessary permits or provide access to private parking.
8.2 If we receive a parking penalty because you failed to provide accurate information about parking or did not arrange appropriate permits, we reserve the right to recover the full cost of the penalty and any related administrative charges from you.
8.3 If adequate parking or access cannot be provided, and this prevents us from safely carrying out the Services, we may cancel the job and charge a reasonable call-out fee.
9.1 We operate in accordance with applicable UK waste legislation and regulations. This includes holding appropriate waste carrier registration and disposing of Waste only at authorised facilities, with due regard to recycling and environmental responsibilities.
9.2 We will take reasonable steps to ensure that Waste collected from you is handled, transported and transferred lawfully and responsibly. Where required, we may issue receipts or transfer notes to confirm the movement of Waste.
9.3 You confirm that you are the owner of the Waste or that you have full authority from the owner to request its removal. You shall indemnify us against any claim made by a third party alleging that the Waste did not belong to you or that its removal was not authorised.
9.4 You must not request us to remove any Waste that you know or suspect to be unlawful to possess or transfer. If such materials are discovered, we may notify the relevant authorities and take any other steps we consider appropriate.
10.1 We will exercise reasonable skill and care in providing our Services. However, you acknowledge that clearance work involves the manual handling of items and movement through your premises, and that some risk of minor damage may exist.
10.2 You must take reasonable steps to protect any areas of your property that may be vulnerable to damage, including covering floors, removing fragile items from access routes, and giving clear instructions about any particular concerns.
10.3 We shall not be liable for any pre-existing damage, wear, defect or fragility in your property or belongings, nor for damage arising from inadequate preparation or failure to follow our reasonable instructions.
10.4 Our total liability to you for any loss or damage arising out of or in connection with our Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by you for the relevant Services.
10.5 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under UK law.
10.6 We shall not be liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising from the provision of our Services.
11.1 You or your authorised representative must inspect the areas cleared before our team leaves the site and raise any concerns immediately. Once we have left, it may not be possible to revisit easily without additional charge.
11.2 If you believe that we have not carried out the Services as agreed, or if you are dissatisfied for any reason, you must notify us as soon as reasonably possible, and in any event within 48 hours of the collection.
11.3 We will investigate any complaint and may request photographs, access to the property or other information to help us assess the situation. Where we agree that we have not provided the Services with reasonable skill and care, we may offer to re-attend, rectify the issue, or provide a partial or full refund, at our discretion.
12.1 We maintain appropriate public liability and, where applicable, employer's liability insurance to cover our rubbish removal activities, in line with industry practice.
12.2 Details of our insurance cover are available on request. Our liability remains subject to the limitations set out in these Terms and Conditions.
13.1 We collect and process personal data such as your name, contact details, service address and payment information for the purposes of managing your Booking, delivering the Services, processing payment and complying with legal obligations.
13.2 We will handle your personal data in accordance with applicable data protection laws in the UK. We will not sell your personal data to third parties and will only share it where necessary to provide our Services, process payments, comply with the law, or with your consent.
14.1 We shall not be in breach of these Terms nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include acts of God, extreme weather, strikes, accidents, public health emergencies, or disruption to transport networks.
15.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new Bookings made after the revised terms are published or otherwise communicated to you.
15.2 The Terms and Conditions in force at the time of your Booking will govern that particular agreement for Services.
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish removal and waste collection services.
17.1 If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17.2 No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.
17.3 You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to another suitable provider, provided this does not adversely affect your rights.
17.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of rubbish removal and waste collection services and supersede any prior discussion, correspondence or understanding between us relating to their subject matter.
